9. Trade with the enemy. An Indian national can do without a license from the. Government. An agreement with a foreign enemy is illegal, invalid and ineffective. (AGREEMENTS AGAINST PUBLIC ORDER) By law, any agreement that prevents a person from carrying on any profession, trade or legal activity of any kind is void to that extent. Section 23 provides that “where a party to an agreement is totally prevented from asserting its rights or a contract by the usual judicial proceedings before the ordinary courts, or if it limits the period within which it may assert its rights, it is a nullity”. An agreement to exchange the right of guardianship of the parties for his minor child is null and void and is contrary to public order. An agreement on creditor fraud is contrary to public policy and not an agreement. Courts should be very careful when ruling on a matter of public policy.
